Privacy policy

Chocolat Ammann AG operates the website www.chocolatammann.ch. Chocolat Ammann AG is responsible for ensuring that data processing complies with applicable law.

These include:

the Swiss Data Protection Act (DSG);

the Regulation on this Act (VDSG);

the Telecommunications Act (TCA):

Where applicable, the Basic Data Protection Regulation (DSGVO) of the European Union.

By using our website, you declare your consent to data processing within the meaning of Art. 6 para. 1 lit. a DSGVO.

  1. Data processing

Our servers temporarily store each of your accesses to our website in a log file. The following data is recorded:

  • the IP address of the requesting computer
  • the date and time of access
  • the name and the URL of the retrieved file
  • the website from which the access was made
  • the operating system of your computer and the browser you use
  • the country from which you accessed the site and the language settings of your browser
  • the name of your Internet access provider

This data is collected and processed to enable the use of our website (connection establishment), to ensure system security and stability, for the optimization of our Internet offer as well as for internal statistical purposes. The IP address is stored in order to be able to react appropriately to attacks on our network infrastructure.

Please note that we use so-called cookies, tracking tools and social media plug-ins (see clauses 6, 7, 8) and that data may also be passed on to third parties and/or abroad (see clauses 9, 10).

  1. Placing an order

The following data is mandatory so that your order can be recorded:

  • Salutation and/or company
  • First and last name
  • Address (company, street, house number, postal code, city, country)
  • Further contact details (e-mail address, telephone number)
  • Credit card or other payment data

The provision of other information is voluntary.

  1. Data processing for advertising purposes

Data processing for advertising purposes is based on Art. 6 Para. 1 letter f DSGVO, whereby our interest lies in particular in direct marketing and the analysis and evaluation of the use of our website.

We use and analyse your data when you visit our website. So-called cookies may be used for this purpose (see point 6). Their behaviour can be used to create a so-called usage profile. This is only done on the basis of pseudonyms.

We integrate remarketing pixels from Facebook, which allow us to use personalized marketing. If you have an account with one of the social networks included in this site and are logged in at the time of your visit, this pixel links your visit to your account. If you want to prevent this link, you must log out of your account before visiting the site.

  1. Transfer of collected data to third parties

We will only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the relationship between you and Chocolat Ammann AG. In addition, we will pass on your data to third parties as far as this is necessary within the scope of the use of the website for the provision of the services requested by you and for the analysis of your user behaviour, as described above. Insofar as this is necessary for the above-mentioned purposes, the data may also be transferred abroad. If our website contains links to third-party websites, Chocolat Ammann AG has no influence on the collection, processing, storage or use of personal data by the third party after clicking on these links and, to the extent permitted by law, assumes no responsibility or liability for such data.

  1. Transmission of data abroad

General information

Chocolat Ammann AG is also entitled to transfer your personal data to third parties (i.e. commissioned service providers) abroad, insofar as this is necessary for the data processing described in this privacy policy. These third parties are obliged to the same extent as we are ourselves to protect data.

 

Data transfers to the USA

We would like to point out that in the USA, surveillance measures are in place by US authorities which generally allow the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA.

For the rest, we refer to the data protection regulations of the USA.

  1. Retargeting

We analyse your user behaviour on our website in order to be able to offer you individually tailored advertising on partner websites. Your user behaviour is recorded pseudonymously.

You can prevent re-targeting at any time by rejecting the relevant cookies in the menu bar of your web browser, or by deleting them from your computer.
  1. Cookies

Cookies are information files that your web browser automatically stores on your computer’s hard drive when you visit our website. Cookies help us to make your visit to our website easier, more pleasant and more meaningful. We use cookies to better tailor information, offers and advertising to your individual interests. However, you can configure your browser so that no cookies are stored on your computer or so that a message appears every time you receive a new cookie. However, deactivating cookies may mean that you will not be able to use all the functions of our website.

  1. Tracking Tools

The tracking tools allow us to track your surfing behavior on our website. This monitoring is carried out for the purpose of designing our website in line with requirements and for the continuous optimisation of our website.

  1. Facebook

Social plugins from Facebook are used on our website. This is an offer from the US company Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA.

We use the “LIKE” or “SHARE” button for this. Through the integration of these plugins, Facebook receives the information that your browser has called up the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can assign your visit to our website directly to your Facebook account. If you interact with the plugins, for example by clicking the “LIKE” or “SHARE” button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends.

For the rest, we refer to the privacy policy of Facebook.

  1. Data security and confidentiality

Continuously optimized technical and organizational security measures are designed to protect your personal data stored with us against manipulation, loss and unauthorized access by third parties.

You should treat your payment information (e.g. credit card data) confidentially.

  1. Inspection of personal data

You have the right to request information about your personal data stored by us about you, to request any corrections and deletion of your personal data, unless this is contrary to a legal obligation to retain data or a permission to process the data.

You can revoke the data processing for which you have given your consent at any time. You can contact us for the above-mentioned purposes via the e-mail address info@chocolatammann.ch. For the processing of your applications we may, at our discretion, require proof of identity.

  1. Retention period of the data

We store personal data only as long as necessary,

  • to use the above-mentioned tracking, advertising and analysis services within the scope of our legitimate interest;
  • to perform services to the extent specified above that you have requested or for which you have given your consent;
  • to comply with our legal obligations.

Data in connection with a contract will be kept for 10 years in accordance with the Swiss legal provisions.
